    Terms and Conditions / Legal Notice

    ARTICLE 1: Overview of the antilla-martinique.com website, legal notices, and scope of these General Terms and Conditions of Sale

    1.1 ANTILLA publishes the rolling news service antilla-martinique.com available, in particular, in its web version at the following address www.antilla-martinique.com.

    1.2 Legal Notices and Contact Information:
    The website www.antilla-martinique.com is published by ANTILLA, a company with a capital of €1,000, registered with the Fort-de-France Commercial Register under No. 32939586700016. Headquarters: 7 Rue Paul Gauguin – 97232 Le Lamentin – Martinique – Tel.: 0696732626.

    The CPPAP number is: 0529 Y 94923

    Host for the website's web version: 1AND1 / IONOS

    Customer service is available Monday through Friday from 9:00 a.m. to 7:00 p.m. and Saturday from 9:00 a.m. to 1:00 p.m.

    1.3 These Terms and Conditions govern the website referred to above

    ANTILLA invites the customer to save and/or print these general terms and conditions of sale by clicking on the icon corresponding to each of these functions.

    ARTICLE 2: Terms and Conditions of Sale for ANTILLA Products and the ANTILLA Subscription

    3.1 Several payment methods are accepted on the antilla-martinique.com website

    Orders are paid for by credit card through HIPAY, the secure multichannel payment platform. The following credit cards are accepted:

    • Carte Bleue
    • Visa Card
    • Eurocard/Mastercard

    Online payment by credit card is processed through a secure system that uses SSL (Secure Socket Layer) encryption. At no point during the transaction ANTILLA and Concept CV do not have access to bank account information.

    The customer's bank account will be debited 4 days after the order date, and the order will be considered finalized once the bank's payment processing centers have confirmed approval. If the bank declines the transaction, the order will be automatically canceled.

    The prices of products sold on the website are listed in euros, including all taxes, but excluding processing and shipping fees (see the «Shipping Costs» section).

    No order will be shipped until full payment (including shipping costs) for the merchandise has been received. The products remain the property of ANTILLA until full payment has been received.

    ANTILLA reserves the right to change its prices at any time. Products will be billed based on the prices in effect at the time the order is placed (subject to availability).

    3.2 The customer has a 14-day cancellation period, starting from the date of receipt of the product, to return any product that does not meet their expectations. If the last day of the period falls on a Saturday, Sunday, or a holiday, the period expires on the next business day. To qualify for a refund, returned products must be in perfect, resalable condition and complete, including the original packaging.

    To exercise this right of withdrawal, the products must not have been unpacked. Only the price of the purchased product(s) will be refunded; the customer is responsible for the cost of returning the product(s).

    3.3 If a product is defective or does not match the order, the customer may return the product within 7 days of the date of receipt to the address listed above, noting any damage or discrepancies on a copy of the delivery slip. In this case, ANTILLA will endeavor to replace the defective or non-conforming product. If this proves impossible, a refund for the order will be issued. Subject to verification that the claim is valid, the costs of return shipping and reshipment will be borne by ANTILLA.

    3.4 Refunds under the circumstances described in paragraphs 3.2 and 3.3 above will be issued within a maximum of 30 days after receipt of the products by ANTILLA, subject to any additional time required by the product’s supplier or manufacturer in the event of a claim regarding a defect or non-conformity in the product. The refund will be issued to the credit or debit card used for payment. The time it takes for the bank account to be credited depends on the type of card the customer has: for an immediate-debit card, the checking account is credited within 3 to 8 days, depending on the bank; in the case of a deferred-debit card, the credit will appear under the same conditions as those for standard deferred debits. If the refund takes longer than expected, the customer is strongly advised to contact their bank.

    3.5 It is noted that, in any event, the customer is covered by the statutory warranty of conformity and the statutory warranty against hidden defects in accordance with the provisions of Articles L 211-4, L 211-5, and L 211-12 of the Consumer Code and Articles 1641 and 1648 of the Civil Code.

    3.6 If a product is unavailable after an order has been placed, the customer will be notified by email or phone regarding the delivery of a partial order or the cancellation of the order.

    If the payment (debit) has already been processed, the amount corresponding to the unavailable item will be refunded. An email will be sent to the customer regarding this matter. The time it takes for the bank account to be credited depends on the type of bank card the customer has: for an immediate-debit card, the checking account is credited within 3 to 8 days, depending on the bank; for a deferred-debit card, the credit will appear under the same conditions as those for standard deferred debits. If this refund takes longer, the customer is strongly advised to contact their bank.

    3.7 The average order processing time is 3 business days. Subject to product availability, orders for print subscriptions are dropped off at the post office or shipped within 48 to 72 hours.

    Products are shipped to the shipping address provided by the customer during the ordering process. This address may differ from the billing address.

    Customers can check the status of their order at any time by calling customer service at the following number: 0696 73 26 26.

    3.8 The contribution toward processing and shipping costs includes tax. Shipping costs are detailed in Article 9.

    ARTICLE 4: Terms and Conditions of Sale for ANTILLA Publications

    Customers can purchase individual issues of ANTILLA’s various publications online. They can also subscribe to the weekly magazine. ANTILLA, either in print or in its digital version (PDF).

    4.1 Single-Issue Sales

    Sections 3.1, 3.2, 3.4, 3.5, 3.6, 3.7, and 3.8 above apply to the sale of ANTILLA publications on the antilla-martinique.com website.

    In accordance with Article L121-20-2(5) of the Consumer Code, the right of withdrawal does not apply to the sale of newspapers, periodicals, and magazines. Article 3.3 therefore does not apply to ANTILLA’s publications.

    Print publications are shipped in accordance with the terms set forth in Articles 3.7 and 3.8.

    The digital (PDF) edition of ANTILLA is available for viewing one day after payment is made

    Shipping charges are detailed in Article 9.

    4.2 Subscription-Based Sales

    ANTILLA offers two subscription options for the weekly magazine on its website ANTILLA, in print or digital format.

    Details about each offer (price, duration, etc.) are available on the website.

    You have two options:

    Print subscription: Refers to a subscription to the print edition of the magazine.

    Digital Offer: Refers to a subscription to the digital edition (PDF), provided that the customer provides us with a valid email address

    4.2.1 Print Subscription:

    4.2.1.2 One-year subscription:

    ANTILLA offers a one-year subscription for 150 euros, including tax (VAT at 1.05%). Payment is made in a single installment on the website. This subscription can be paid for by credit card or check only.

    4.2.1.3 Deadlines, temporary address changes, subscription suspension:

    The delivery schedules and times for subscribers to ANTILLA's print publications are those typically followed by the postal service.

    While on vacation or traveling, subscribers may have their newspaper forwarded by providing ANTILLA with their temporary address and the dates of their absence at least 10 days before the effective date of their change of address. Subscribers may also suspend their subscription. Address changes and subscription suspensions must be requested by the subscriber via email sent to philippepied@gmail.comor by phone at the following number: 0696732626.

    4.2.1.4 Failure to pay:

    If a payment is declined or a payment is past due, the subscription will be suspended until the issue is resolved. The customer will then be notified of the suspension of their subscription.

    4.2.2 Digital Edition Subscription:

    ANTILLA also offers a subscription plan for the digital edition at a flat rate of 110 euros (including VAT at 1.05%)

    This annual subscription requires a one-time payment by credit card at the time of sign-up.

    The digital edition is available the day before the print edition is published, which is Wednesday.

    End of the subscription: At the end of this subscription period, it is not automatically renewed, but ANTILLA will be able to contact the subscriber by any means to invite them to renew their subscription and present them with new subscription offers.

    4.2.3 Failure to pay:

    If a payment is declined, the subscription will be suspended until the issue is resolved. The customer will then be notified of the suspension of their subscription.

    ARTICLE 5: Newsletters

    You may opt out of receiving the Antilla newsletter at any time, free of charge, by clicking the «unsubscribe» link included in each email.

    ARTICLE 6: Liability and Warranty

    The products offered for sale comply with current French law.

    ANTILLA shall not be held liable in the event of non-compliance with the laws in effect in countries other than France (Martinique) where the items will be delivered or used, if applicable. It is therefore understood that it is the customer’s responsibility to verify, with the relevant local authorities, whether the ordered items may be imported or used.

    ANTILLA shall be liable only if ANTILLA has failed to fulfill one of its obligations, causing direct and certain harm to the customer. It cannot be held liable for mere errors or omissions, particularly in the presentation of products on the website.

    ANTILLA's liability shall, in any event, be limited to the amount of the order.

    ANTILLA shall not be held liable for any failure to perform its obligations in the event of force majeure (including, but not limited to: flooding, fire, natural disasters, armed conflict, acts of state, disruptions, or total or partial strikes, particularly affecting postal services, transportation, and/or communications).

    Product images are for illustrative purposes only and are not binding.

    ANTILLA acts as a content publisher, not as an Internet service provider. As such, it cannot guarantee either the quality of the Internet connection or the absence of network-related interruptions.

    ARTICLE 7: Intellectual Property

    ANTILLA and Concept CV are the exclusive owners or rights holders of all intellectual property rights on the antilla-martinique.com website and in the various content published by ANTILLA on the site, including: graphic designs, titles, formats, site maps, text, photographs, images, videos, and any other informational content, as well as logos and trademarks ANTILLA – Concept CV. ANTILLA and Concept CV are are also the exclusive owners or beneficiaries of all intellectual property rights in the publications published by ANTILLA and sold on the antilla-martinique.com website.

    ANTILLA grants the user a license conferring a simple right of private, non-collective, and non-exclusive use.

    With regard to digital or online content, this right of use includes the right of reproduction, solely for the following purposes: storage for the purpose of display on a single-user screen (on any device, including mobile devices), and reproduction of a single copy to create a backup or a hard copy (using the «print» function).

    In general, unless expressly authorized in advance by ANTILLA, it is prohibited to:

    to photocopy, scan, or reproduce in any other way all or part of the content published by ANTILLA, in any format whatsoever; ;

    to modify, adapt, or translate all or part of the content published by ANTILLA;

    to distribute, rebroadcast, or share online all or part of the content published by ANTILLA in addition to the features offered by ANTILLA on the antilla-martinique.com website, allowing users to share content online on social media or send it via email to a friend or family member; ;

    to sell or exploit for commercial purposes, in any form whatsoever, all or part of the content published by ANTILLA

    ANTILLA reserves the right to implement any technical measures necessary to limit the reproduction and distribution of its content by users.

    Unless expressly authorized in advance by ANTILLA, it is also prohibited to reproduce or use the trademarks and logos appearing on the website and in ANTILLA’s publications, which are registered trademarks.

    Any use other than those expressly authorized or prohibited by the foregoing provisions is subject to ANTILLA’s express prior authorization.

    Any violation of this clause shall be deemed an infringement and may result in civil and/or criminal prosecution in accordance with the law.

    ARTICLE 8: Personal Data

    8.1 The personal data collected by ANTILLA consists of the information that the customer voluntarily provides when placing an order (username, which may be the user’s name; a valid email address; and a password) and when placing orders (last name, first name, address, and, if applicable, date of birth).

    The information requested from customers—some of which is identified as such—is necessary to process and fulfill orders, while other information is useful for getting to know our customers and improving the services offered on the website.

    The customer agrees to provide ANTILLA with accurate personal information. ANTILLA implements all appropriate measures to minimize the risk of loss, damage, or misuse of the collected data.

    In accordance with the French Data Protection Act, the customer has the right to access and correct personal data concerning him or her. The customer may also object, for legitimate reasons, to the processing of such data. The customer may object, without providing a reason, to the use of their data for marketing purposes, particularly commercial marketing. This right of access, rectification, and objection may be exercised at any time by sending a message to philippepied@gmail.com

    8.2 ANTILLA is not responsible for the processing of personal data that may be provided by the customer in connection with services offered by ANTILLA’s partners on the antilla-martinique.com website or services accessible through the website. Similarly, payment-related data—including, in particular, credit card numbers and identifiers—is collected and (in the case of subscription payments via direct debit) stored by Klik&Pay. ANTILLA does not have access to this data.

    8.3 The customer is informed that ANTILLA wishes to place a «cookie» on your computer. A «cookie» is a text file that stores information about your browsing activity on the site. It cannot be used to retrieve data from the user’s hard drive, install a virus, read the user’s email address, or obtain personal information. It does not allow ANTILLA to identify the user. However, it records information about your browsing activity, which may be used during future visits.

    However, the customer has the option to block cookies by configuring their browser accordingly, for example:

    For Mozilla Firefox:

    1. Select the «Tools» menu, then «Options»
    2. Click the «Privacy» icon»
    3. Find the «cookie» menu and select the options that work for you

    For Microsoft Internet Explorer:

    1. Select the «Tools» menu, then «Internet Options»
    2. Click the «Privacy» icon»
    3. Use the slider to select the desired level

    The customer can also, when creating their user account, uncheck the «Keep me logged in» box.

    ARTICLE 9: Acceptance of the General Terms and Conditions of Sale, Jurisdiction, Miscellaneous Provisions

    9.1 By accessing the antilla-martinique.com website, placing an order on the site, and checking the box provided for this purpose, the user expressly and unconditionally accepts these general terms and conditions of sale.

    9.2 ANTILLA reserves the right to modify these general terms and conditions of sale at any time. The applicable general terms and conditions of sale are those in effect at the time of the order, which the customer accepts upon confirming the order. The general terms and conditions of sale are available for review at any time on the antilla-martinique.com website. They can be saved and printed by clicking on the icons corresponding to these functions.

    9.3 In the event of a dispute, the customer should first submit a complaint to ANTILLA at the following address: philippepied@wanadoo.fr, in order to reach an amicable resolution. If an amicable resolution cannot be reached, any dispute regarding the validity, interpretation, or enforcement of these General Terms and Conditions of Sale shall be submitted to the competent French courts. French law shall apply.

    9.4 In the event that any of these provisions is invalidated or deemed unenforceable against the customer by a court ruling, all other provisions of these General Terms and Conditions of Sale shall remain in full force and effect.

    The tables below summarize the shipping costs for all products sold on the ANTILLA-MARTINIQUE.COM website, excluding subscriptions (single-issue copies of ANTILLA and select products sold in the online store).
