    Marine Le Pen: Conviction Upheld, but the Path to the 2027 Presidency Remains Open.

    The Court of Appeals’ decision fundamentally changes the political landscape. If Marine Le Pen’s criminal liability is upheld in the case involving European parliamentary assistants, the reduction in the length of her ineligibility period could allow her to run in the next presidential election.

    A conviction upheld on the merits

    The Court of Appeals upheld Marine Le Pen's conviction for misappropriation of public funds in the case involving European parliamentary assistants.

    She imposes a sentence of three years in prison, two of which are suspended, leaving one year of imprisonment, with the possibility of parole, as well as a a fine of 100,000 euros.

    The decision therefore upholds the criminal findings of the trial court: the facts have been established, and the National Rally leader remains liable.

    The narrowed ineligibility criteria are a game-changer

    The major change concerns the political sanction: ineligibility is reduced to 45 months, including 30 months suspended, or 15 actual months.

    This decision by the Court of Appeals alters the practical implications of the original ruling. The penalty should no longer prevent Marine Le Pen from running in the 2027 presidential election.

    Since the actual period of ineligibility is calculated from the March 2025 conviction, it would end before the election scheduled for April 2027, barring any new legal developments.

    The battle is shifting from the legal arena to the political arena

    Any appeal to the Court of Cassation would not concern a new assessment of the facts, but rather the legal validity of the decision.

    The central issue, therefore, is less one of eligibility than of the political impact of a criminal conviction in a presidential campaign.

    Marine Le Pen could legally run for office in 2027, but her opponents will have a major argument to make: that of public integrity. Conversely, her supporters could denounce the judicial system as being used for political ends and seek to turn this conviction into a political opportunity.

    A Tense Presidential Election

    This decision therefore leaves the 2027 race open while creating a paradox: a candidate who could potentially run in the highest-level election but is burdened by a criminal conviction.

    Ultimately, it would no longer be up to the judges alone to decide, but up to the voters to determine the political weight they will give to this case.
